Swiftpikup Terms and Conditions

Welcome to Swiftpikup! These Terms and Conditions ("Agreement") govern your use of the Swiftpikup application ("App"), available for download and use on your device. By accessing or using Swiftpikup, you ("User") agree to comply with and be bound by the following terms. If you do not agree to these terms, you are prohibited from using this App.

 

1. General Terms

1.1 Agreement to Terms: By using Swiftpikup, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you may not use the App.  

1.2 Modification of Terms: Swiftpikup reserves the right to modify or amend these Terms and Conditions at any time. You will be notified of such changes, and continued use of the App after such modifications shall constitute your acceptance of the updated terms.

 

2. Driver Terms and Conditions

2.1 Eligibility Requirements: As a driver ("Dispatcher"), you must have the order value in your wallet to accept any delivery. If your wallet balance is insufficient, the App will prompt you to add funds to your wallet to meet the required amount.  

2.2 Withdrawals: You may request a payout of your earnings at any time. However, please note that all withdrawal requests are subject to approval within 72 hours, provided there are no pending orders.  

2.3 Commissions: Swiftpikup takes a commission from each completed order. The commission can be deducted either from the driver’s wallet or directly from the customer’s payment card, depending on the payment method used for the transaction.  

2.4 Payout Processing: Once approved, funds in your wallet may be withdrawn to your designated bank account at any time. All funds in your wallet belong to you and are fully available for withdrawal.  

2.5 Loss or Dispute of Package: In case you lose a customer’s package or if a customer files a dispute against you, Swiftpikup will open an investigation into the matter. An investigation will take up to 14 days. If you are found responsible for the loss or damage, you will be required to compensate the customer for the lost goods.  

2.6 Required Signatures: You are required to obtain the customer's signature at the time of delivery to confirm the receipt of goods. You must ensure that you do not leave the customer's goods without ensuring they are under the responsible party's care.  

2.7 Stealing or Misappropriating Goods: Any instance of theft or intentional damage of a customer's package will result in immediate termination from the Swiftpikup platform.

 

3. Customer Terms and Conditions

3.1 Reporting Disputes: Customers may report any issues or concerns related to their deliveries within a 48-hour window. After 48 hours, complaints will be deemed invalid, and Swiftpikup will not entertain any requests or disputes regarding past deliveries.  

3.2 Charges: Swiftpikup charges a service fee for delivery requests. This fee may vary depending on the specifics of the request, such as distance, package size, and delivery urgency. The fee is subject to change at any time, and the updated fees will be communicated during the booking process.

 

4. Swiftpikup Responsibilities

4.1 Investigation of Disputes: If a dispute arises between a customer and a driver, Swiftpikup will investigate the issue thoroughly. We will ensure that all parties have an opportunity to present their case and will make a final decision based on available evidence.  

4.2 Jurisdiction Compliance: All users must comply with the local laws and regulations governing their jurisdiction. Swiftpikup disclaims any responsibility for violations of local laws by users.

 

5. Prohibited Conduct

5.1 Misuse of Platform: You agree not to use the Swiftpikup platform for illegal activities, including but not limited to fraud, theft, or any other form of misconduct.  

5.2 Unauthorized Transactions: Any unauthorized use of Swiftpikup's services to perform fraudulent transactions will result in immediate termination of the user’s account.

 

6. Limitation of Liability

6.1 Swiftpikup’s Liability: Swiftpikup’s liability for any loss, damage, or injury arising from the use of the App or services provided is limited to the amount paid by the user for the service in question, excluding any indirect, incidental, or consequential damages.  

6.2 Indemnification: Users agree to indemnify and hold harmless Swiftpikup, its officers, employees, and agents from any claims, losses, or damages resulting from their use of the App or violation of these Terms and Conditions.

 

7. Termination

7.1 Termination by User: You may terminate your account at any time by following the account deactivation procedures in the App.  

7.2 Termination by Swiftpikup: Swiftpikup reserves the right to suspend or terminate your account for any violation of these Terms and Conditions, including fraudulent activity, theft, or failure to comply with the required standards of service.

8. Governing Law

8.1 Jurisdiction: These Terms and Conditions will be governed by and construed in accordance with the laws of [Insert Jurisdiction], and you submit to the exclusive jurisdiction of the courts located within [Insert Jurisdiction].

9. Miscellaneous

9.1 Severability: If any provision of these Terms and Conditions is found to be invalid, the remaining provisions shall continue in full force and effect.  

9.2 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and Swiftpikup regarding the use of the App and supersede all prior or contemporaneous communications, agreements, and understandings.

By using Swiftpikup, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree, you are not permitted to use the App.
